He claims that AOC employed an undocumented immigrant and assisted in helping others evade immigration enforcement. Homan shared the allegations during an appearance on conservative podcaster Benny Johnson’s show.

The controversy centers around Diego de la Vega, who reportedly served as AOC’s Deputy Communications Director. According to Homan, de la Vega lacked legal immigration status and allegedly helped another undocumented individual avoid deportation. Homan referenced federal laws that make it a criminal offense to obstruct or hinder the removal of undocumented immigrants.

Further criticism was directed at AOC’s office for hosting a bilingual “Know Your Rights” webinar. The session offered advice such as refusing ICE agents entry without a warrant and seeking pro bono legal help. Homan claimed this guidance could interfere with lawful immigration enforcement.

Speaking on Fox News, Homan revealed that the Department of Justice (DOJ) is reviewing whether AOC’s actions cross the line into criminal conduct. He called the materials shared during the webinar “potentially illegal” and accused the congresswoman of undermining law enforcement operations.

AOC responded defiantly, asserting her right to free speech and the duty to inform her constituents of their constitutional protections. During a town hall, she dismissed Homan’s threats, saying, “Come for me, do I look like I care?” She added that Homan was “in desperate need of a constitutional education.”
